These Terms & Conditions apply when you use our website, contact us about our services, or engage us to provide website design, digital marketing, automation or related services. By engaging our services, you agree to these Terms together with any written proposal, order, statement of work or other agreement we provide.

2. Scope of Services

The exact services, deliverables, timeline and responsibilities for each project will be confirmed in writing. For the promotional website campaign shown on our website, the agency website design and build fee may be £0, subject to the eligibility and conditions communicated to the client.

3. Wix Subscription and Third-Party Costs

A Wix subscription is required to host and publish a Wix website. Unless we expressly agree otherwise in writing, the client is responsible for purchasing and maintaining the required Wix plan and for any other third-party costs, such as domains, premium apps, paid integrations, advertising spend or external services. Third-party purchases are subject to the relevant provider’s own terms and refund policies.

4. Client Responsibilities

You are responsible for providing accurate business information, content, images, branding materials, approvals and any access reasonably required to complete the project. You confirm that you have the right to use any content, trademarks, photographs, logos or other materials you provide to us.

5. Project Start and Delivery

Unless otherwise agreed in writing, work begins after the required Wix plan has been purchased and the information needed for the project has been received. Delivery times may depend on how quickly the client provides content, feedback, approvals and access.

6. Revisions and Changes

Reasonable revisions included in a project will be explained during onboarding or in the applicable proposal. Requests that materially change the agreed scope may require additional time or a separate fee, which will be agreed before the extra work begins.

7. Intellectual Property

You retain ownership of the original content and materials you provide to us. Unless otherwise agreed in writing, once the project has been completed you may use the final website created for your business. Wix, third-party software, stock assets, fonts, apps, templates and other third-party materials remain subject to their respective licences and terms.

8. AI and Automation

Our bespoke builds interface securely with distinct external application services, remote computing API layers, cloud databases, and content architectures. We hold no command over these public systems and will not render support for any external technical drops, vendor policy adjustments, or tool outages.

9. Marketing and Performance

We design websites and related services to support a professional online presence and make it easier for potential customers to engage with a business. However, we do not guarantee a specific number of leads, sales, search-engine rankings, conversion rates, revenue or other commercial results.

10. Third-Party Platforms

Our services may depend on third-party platforms such as Wix, WhatsApp, analytics providers, automation tools, domain registrars or advertising platforms. We are not responsible for outages, account restrictions, policy changes, pricing changes or technical failures that are outside our reasonable control.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Exclusive AI Agency will not be liable for indirect, incidental or consequential losses arising from the use of our services or third-party platforms. Nothing in these Terms excludes any liability that cannot legally be excluded.

12. Suspension or Termination

We may pause work if required information, access or third-party services are unavailable, or if agreed payments for paid services are overdue. Either party may end an ongoing service in accordance with any cancellation terms stated in the applicable proposal or service agreement.

13. Privacy

How we collect and use personal information is explained in our Privacy Policy, which forms part of the information available on this website.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will be published on our website with an updated effective date. Changes will not retrospectively alter a separately signed agreement unless both parties agree.
